PRESS ARTICLES BY THIERRY MAREMBERT
Interview on French corporations and U.S. anti-corruption laws and trading with embargoed countries
Les Echos, "Cybercrimes: Soon, being able to access a website is all it will take"
All it takes is for a website to be accessible in France, and a French court can award damages for prejudice incurred in France. This was what the Court of Cassation decided on January 22, 2014, thus concurring with the European Court of Justice.
Les Echos, "On the reinforcement of corporate executives’ fiduciary duty"
Company executives’ fiduciary duty is being constantly broadened and reinforced. This principle, however, is nowhere mentioned in existing laws. It was not until the end of the 1990s that the Court of Cassation’s Commercial Division, influenced by British and American common law, defined the principle.
Libération, "Illegal evidence: we should put an end to the madness"
This was an article on the Court of Cassation’s declaring the secret recordings made at Mrs. Bettencourt’s home admissible.
Interview "Transforming criminal justice in order to improve the trial phase" This interview came in the wake of a chapter that Thierry Marembert wrote in “80 Suggestions That Won’t Cost a Fortune", published by Grasset and edited by Patrick Weil.
Interview on Thomas Hugues’ “Médias Le Magazine” TV show on France 5 discussing the risks of hate speech working its way onto call-in talk radio and TV shows, as when a listener told Sud Radio that Dominique Strauss-Kahn was “being supported by a Jewish lobby.”
Les Echos, "Full and Fair Presentation of Evidence: the Founding Principle of All Trials"
Certain parties, certain officials, are sometimes inclined to use stolen or secret documents as evidence. Although this seems to run counter to the integrity of the trial process, the courts have traditionally placed the search for truth and the effectiveness of law enforcement above all other concerns. The principle of full and fair presentation of evidence, however, is slowly gaining ground.
