All it takes is for a website to be accessible in France, and a French court can award damages for prejudice incurred in France. This was what the Court of Cassation decided on January 22, 2014, thus concurring with the European Court of Justice.

Company executives’ fiduciary duty is being constantly broadened and reinforced. This principle, however, is nowhere mentioned in existing laws. It was not until the end of the 1990s that the Court of Cassation’s Commercial Division, influenced by British and American common law, defined the principle.

Certain parties, certain officials, are sometimes inclined to use stolen or secret documents as evidence. Although this seems to run counter to the integrity of the trial process, the courts have traditionally placed the search for truth and the effectiveness of law enforcement above all other concerns. The principle of full and fair presentation of evidence, however, is slowly gaining ground.
